The Telecomma Debate - $Million Punctuation Diddle

A good argument for Plain English in documents if there ever was one!


At the heart of the issue was a single sentence in the contract, which read: “This agreement shall be effective from the date it is made and shall continue in force for a period of five (5) years from the date it is made, and thereafter for successive five (5) year terms, unless and until terminated by one year prior notice in writing by either party.”

That sentence has since been e-mailed around the world as academics, legal experts, newspapers, radio commentators and students argue over the true intent of the words. Aliant argues the second comma allows it to scrap the 14-page contract, since the termination applied to both the first five years and the subsequent five-year periods.

Well the reality 'As I See It' is that Aliant knew damned well at the outset that the intent was to assure five years of access at the negotiated price and that after the first five years Rogers had the right to renew for an additional five years unless there was a one year notice of cancellation by either party.

What Aliant did was review the text of the document and discover a little grammatical loophole that allowed them to reopen the access cost issue ......clever and disingenuous !

A person would have to be a complete idiot to believe that either party meant anything different at the outset! Enter the courts and the CRTC.............

Well this should be a lesson to all that write contracts to use plain English and forget about the complex, concatenated sentences!

Soul Brother Number 1 - Gone to God!

In 1965 or so I was just a teenager. I had a keen interest in music and I was already sick to death of hearing the Beatles non-stop on commercial radio. My music was shaped by the late night AM skip that brought US based mega-stations north after about 11:00 pm. These stations had character and late night DJs that knew music. They were located in Detroit and Chicago and New York. They were Big and They were BAD.
They played all sorts of stuff that NEVER made the daytime playlists ( in Canada anyway ) and one of the most memorable was WABC from NewYork City.

The Swingin' Night Walker ... Ron Lundy ... came on at midnight Eastern time and brought the very best of R&B and Soul music. I will never forget the first time I heard him spin James Brown's version of Kansas City...Kaboom! With a one bar lead in from the horns The baseline hits on the one and the rest of rythm section picks it up .... a hard driving romp that ROCKs ... James Brown and the Famous Flames Kicking ASS with the BIG BEAT! This was no group of artsy little choirboys with teddy bear cuddle appeal for gum chomping little girls. This was hard edged, sweaty, sex music ..... all the stuff that those bible thumpin' Baptists and such were ranting about ...... bringing down the morals of society and taking impressionable youth onto the path of ruin. James Brown was called many things in the day but I know that what he was in reality was the MAN ...... the guy all the other music frontmen wanted to be or tried to be.

What's Up With The Crocus Fund? The MB PC's Are Asking

You’d have an easier time nailing Jell-O to the wall than getting Brandon West MLA Scott Smith to share what he knows about the Crocus Investment Fund.

The province’s former industry minister and the man responsible for the labour-sponsored fund in the months leading up to its demise, Smith has been as slippery as an eel when faced with questions about the fund.

In the last two weeks, opposition MLAs have finally received the chance to try and pin down Smith on what he knew and when about Crocus’ problems. The fund stopped trading on Dec. 10, 2004, just a couple of months after Smith was shuffled from the industry beat to intergovernmental affairs and trade. It’s estimated that 34,000 Manitobans lost $60 million as a result of the fund’s problems.

Smith, who now holds the title of Minister of Competitiveness, Training and Trade, has been hounded all fall by the opposition Progressive Conservatives about the role David Woodbury, a political staffer working under Smith, played in terms of relaying issues related to Crocus to Smith and Premier Gary Doer.

During the fall legislative session, Smith was never forced to rise to answer any questions related to Crocus or Woodbury; Doer or Finance Minister Greg Selinger always stepped into the breach to save their colleague from Brandon West. Smith didn’t have that luxury when he finally faced the legislature’s public accounts committee, yet he proved himself more than capable of stonewalling when faced with a simple yes or no question.

Consider this exchange, courtesy of Hansard, between Smith and Ste. Rose PC MLA Glen Cummings.

Cummings asked four times if Woodbury briefed Smith on the Crocus fund, and not once was he given a direct answer:

“I know the members both in the House and at committees have asked many times, was it the butler in the pantry with a tuba? Quite frankly, the members have launched out many names over many, many years regarding this issue,” Smith said at one point. The public accounts committee met again Thursday, and once again it got next to nowhere in terms of new information on Crocus.

This proves two things. First, Manitoba’s public accounts committee is a toothless tiger compared to other legislative committees elsewhere that have the power to compel witnesses to testify and do independent research. Second, Manitobans will get no answers or insight into what really happened with Crocus on Smith and the NDP’s watch without a public inquiry. Unfortunately, a camel will pass through the eye of a needle before Doer voluntarily calls an inquiry into the fund’s demise.

Something obviously went terribly wrong with Crocus, and it’s important that all government members who had knowledge of the board’s undocumented problems before December 2004 account for what they knew and why it appears they did nothing to stop it.

Smith, especially, is at the eye of that storm of public perception: he was the minister responsible for Crocus when it was forced to write down its value and wrestle with liquidity problems, and he was also the minister who signed an agreement in principle to launch an even-bigger “superfund” — an initiative that fortunately went nowhere at the time.

Quite frankly, it’s sad he won’t even answer a simple yes-or-no query about Crocus. Manitobans deserve answers, not backside-covering, from their elected officials. It seems only a judicial inquiry — and unfortunately, that’s something only those same elected officials can order — will ever get to the bottom of the Crocus mess.

This is a comparison I feel is specious at best since a Swastika is a Hindu symbol of good fortune and power....only becoming associated with a form of human evil as it was adopted by the German Nazis of the 1930's.
However....let's say that it is noteworthy that "some" Europeans are sufficiently disturbed by the symbolism of the Arabic dress that is prescribed by Islamofascists that the two symbols are being compared and linked in the minds of such people. The "leftist" intellectuals of EU are hardly prone to recognizing or admitting the threat that the cult of death represents.

First up: Local Cable news feed with a voice track....Some twit going on about the SSM debate with the comment that the institution of same sex marriage is the equivalent of Womens Suffrage or the abolishment of slavery! Yeah Right..............
Next: CTV NewsNet Live broadcast of the Commission (Arrar Inquiry).....Observe Stockwell Day responding to Mark Holland...calling Holland out on the BS he's been dishing and really getting in a good dig. Pompous Posturing Holland goes into a tirade in an apparent emulation of Ted Kennedy...Too bad the Chairman cut him off...I'm sure he was going to sink himself....But Good!
Next: CBC more of the same.......no surprise!
Next: CNN - Bush and Blair in front of the Media...GW Gives a good lecture on What's Really Important to airhead reporters. Reporters continue to act like they've been living on another planet............
Next: ROB TV......Lots of inconsequential blather about hedge funds, trusts, tax and a couple of Exec's doing their best sales pitch to investors........ courtesy of Bell Globemedia! A couple of Billion$ of Canadians hard earned dough and a lot of improperly confiscated (stolen) private property combined with the criminalization of thousands of law abiding citizens and where are we?

OTTAWA - Stephane Dion, the new leader of the Liberal Party of Canada, is dismissing questions about his dual citizenship with France, saying he has proven he has ''100 per cent'' loyalty to Canada and he doesn't appreciate anyone questioning it.

Dion told reporters Tuesday he does not see the need to renounce his French citizenship and grew testy when pressed about a potential conflict of interest, saying such a possibility was ''impossible'' even if he was prime minister.

He snapped when New Democrat MP Pat Martin's opposing opinion on the matter was raised by a reporter: ''He may keep his opinion to himself. I am proud of who I am and I am fully loyal to my country. I think I have proven it and no one will question it.''

Martin said it would be: ''common sense for Dion to renounce his French citizenship.''

''Mr. Dion should not have divided loyalties,'' the Manitoba MP said. ''If he were ever to be the premier leader of Canada this is going to be a problem for him and he should not be so dismissive of people raising the question.''

Martin noted he would question the loyalty of someone if they carried memberships to both the Liberals and NDP.

Dion also challenged reporters to give him a reason to renounce his French citizenship.

During the Liberal leadership campaign, Dion told CanWest News Service, he would deal with his citizenship if it became an issue.

''I think it is part of who I am - my loyalty for Canada is 100 per cent. I have proven it, I don't need to prove it even more. People know how much I am committed for my country,'' Dion told CanWest News Service.

The issue appears to be an emotional one for Dion, who cut off further questions about the matter by repeating the phrase ''end of the story'' several times. During the scrum Tuesday, he told reporters to ''move on'' to other questions when it was repeatedly raised.

It did not take long for the issue of Dion's dual citizenship to be raised after he won the Liberal leadership Saturday, with a newspaper column in the West saying it was ''a question of loyalty'' while Bourque Newswatch - a popular news website - featured a headline: ''Citizen Dion: Vive La France!''

Governor General Michaelle Jean renounced her French citizenship in September, 2005, only days before moving into Rideau Hall.

One of the reasons given for dropping her French citizenship, which she had obtained from her French filmmaking husband, is that the governor general is the head of the Canadian military.

Dion, who has French citizenship through his Paris-born mother, Denyse Dion, told the Ottawa Citizen a year ago he does not vote in French elections or hold a French passport.

''Multiple identities should be seen as an asset not a threat,'' said Dion, in an interview before he joined the Martin cabinet as environment minister.

''Identity is something that you add, not what you extract. There is nothing wrong with multiple identities. The hearts of people are big enough to accept different identities. Canadian citizenship will give me my rights. Identity is the way I feel about the country.''

The new leader did study in France, obtaining a PhD from the Institut d'Etudes politiques in Paris.

He was in France during the 1980 referendum on Quebec sovereignty.

Dion did receive support for his position from fellow MPs.

Bloc Quebecois Leader Gilles Duceppe said he saw no reason for Dion to renounce his citizenship even if he became prime minister one day. He said in the 21st Century, with modern politicians, it is unnecessary for dual citizenship to become an issue.

Duceppe believes there are numerous politicians in the European Union with dual citizenship and it is never an issue.

NDP MP Bill Siksay also had no problem with Dion's dual citizenship, saying the Liberal leader's loyalty to Canada is unquestionable.

''I can see no reason why he would have to drop his French citizenship. It's not a problem for me, anyways,'' he said.

Dion also said there are ''millions'' of Canadians who enjoy dual citizenship.

According to the last national census, there are almost 5.4 million people in Canada who began life as citizens of another country.

Of those, slightly more than four million have become Canadian citizens and 3.5 million of those say they are exclusively Canadian.

Many others (552,000) are dual citizens and others (4,030) are citizens of Canada and at least two other countries.

There are 1.37 million immigrants or refugees qualified to take out Canadian citizenship who have not done so.

Convincingly and without resorting to partisan politics, Kuypers strongly illustrates in eight chapters “how the press failed America in its coverage on the War on Terror.” In each comparison, Kuypers “detected massive bias on the part of the press.” In fact, Kuypers calls the mainstream news media an “anti-democratic institution” in the conclusion.
