    9/10 times it’s a legit problem, the neighbour would just ask you nicely. If some nutjob writes you an invoice, you can safely ignore it. Going through someone’s trash and photographing indentifying information on the other hand is a felony, so OOP might’ve just found a way to finance that lawyer for themselves.

    But this is one side of a story in which the neighbour went from 0 to lawyer with no warning and OOP (presumed innocent and tidy) is apparently fed up with the entire country because of that. Seems to me pretty escalatory by the only side presenting the narrative.

    So giving the benefit of the doubt to the othe side: if you are a messy tenant and do not listen to reason, good riddance to you.

      Disagree: You cannot safely ignore this, because it is not a normal invoice and not some primitive nutjob.

      There is a lawyer behind it, and this lawyer wants to get paid. Something that does not go away by itself.

        It is just a lawyer - they can ask and demand anything they like. If it’s unjustified (like here for example) just ignore it.

        If it’s something from COURT, you HAVE to answer it. But lawyers - don’t give them more credit than they deserve

            Context

            The OP is living there for three months. Even IF they are the dirtiest of all tenants (which is unlikely, but still possible), if we take into regard you need at least a month or two to settle and get your essential furniture in place, the remaining time is WAY too short to state something like “kind” strikes or advisories first - which is kinda required for such a formal step through a lawyer if you want to make it grounded and with actual reason.

            The whole matter does sound like a xenophobic lady with too much time and a very short fuse - and a personal friend of her or her family being the lawyer responsible for the whole matter. That’s why I would simply ignore it for the time being.

        you can ignore it if it isn’t a court mandated order. the lawyer wants to be paid, but they don’t need to be paid by OOP. they’re perfectly fine being paid by the harassing neighbor, which is what will happen eventually. there are always some of these harassment cases, and generally they go away if you just ignore them because there is no legal backing. the lawyer just scares you into compliance and if you pay that gets seen as an admission of guilt. there are several types of legal letters but most of them don’t require responding at all.

        I can go to a lawyer and tell them to write “8====D” on a letter, then send that letter to you.

        If you don’t think you did anything wrong, you can legally ignore anything that is not a formal letter from court.

        It might be better to answer to tell them that you will not accept slander and libel and all that, but you should probably ask a lawyer for that. An hour of consultation should not cost that much, really.

          OP is not sure whether it was wrong. He hasn’t even read all the rules of the house yet. Just guessed them…

          And he needs to look at his money. But by ignoring arbitrary letters, you can easily make things a whole lot more costly in the end.

          This is very very much wrong.

          Here’s what would probably happen:

          1. You ignore the cease and desist
          2. Opponent’s lawyer goes to a judge and gets a preliminary injunction
          3. You must respond to it AND also cease doing whatever the cease and desist demanded.

          Enjoy doing everything through the courts now, which will always cause higher costs than dealing with it privately. Especially if you aren’t 100% in the right.

    We all know OP didn’t fold his boxes at all and just stuffed them in there, blocking up the system. Every time the lady wanted to use the paper container it would be blocked and she would have to reach in there and remove all of his shit. Then properly collapse the boxes and put them back. OP has also been told multiple times to fix his shit and there is a sign above the paper container as well.

    The exact same thing happened where I work. Some idiot would just stuff an unfolded box in the paper container and would block it for everyone.

          You and me both know that people like the old lady in the post exist. I’d also assume that someone who collects compost separately from restmüll will probably fold their boxes in a rational manner.

            I know far many assholes like OP that think all the rules are for other people to follow and if they don’t want to do something in a collective environment, they shouldn’t have to. I hope he is moving out. Good riddance on the behalf of all the other residents.

                Your grandma might have had a chance in court depending on the exact situation.

                If there are tree branches growing over her property, then most of the time the neighbor is forced to cut them after is is notified about it.

                If its just a few leaves getting blown over by the wind then chances are rather slim, but its still possible she would win. Depends on your jurisdiction, here it has to be a severe impairment of her ability to use the property.

                  It was leaves from the opposite property line blowing in the wind.

                  Multiple times a day she would be yelling at my grandfather to go pick them up off the lawn (which was perfectly flat and devoid of anything living except super small grass) and would often go out to the porch just to complain, loudly, about how SHE has to do all this work to “get things presentable”

                  My grandmother was just awful.

                I think I used to live next door to her. We had an enormous sugar maple in the front yard, the tallest tree for blocks around. It was also the first to turn color in the fall, a magnificent bright magenta. I could see it from a quarter a mile away.

                Because it was the first to turn, it was also the first to drop its leaves, and leave its hot pink evidence all over the street, especially in my elderly next door neighbor’s yard, and she did NOT appreciate it. Every time I saw her, she ordered me to cut it down, and I would tell her gently that I would never cut down that incredible tree.

                She never tried to sue me, though.

                It outlived her. The tree won.

                How probable is it that the story that OOP told is a lie and there were interactions before?

                From his own weasel-wordy description OOP was regularly blocking the shared paper bin of an apartment building. How probable is it that no other neighbor complained before the alleged letter?

                How probable is it that OOP is lying to make him appear as some poor victim?

    Als jemand, dem es vor zwei Wochen fast den Fingernagel umgeklappt hat beim Versuch, die “gefalteten” Kartons der Nachbarn in die Tonne zu drücken, habe ich absolutes Verständnis mit der alten Dame. In meiner vorherigen Wohnung hatten wir auch eine Person, der das vorherige Zerkleinern der Kartons sehr wichtig war und was soll ich sagen? Sie hatte Recht. Es passt viel mehr in die Tonne, wenn alle es vorher klein machen. Das bedeutet weniger Nebenkosten für alle. Seitdem bin ich auch Kartonagen-Alman.

    Point number one: throwing boxes into the bin with your address labels on is fucking dumb.

    Point number two: throwing boxes into the paper bin without flattening then is also fucking dumb.

    Obviously, if that’s all the guy did (provided this story has any basis in reality at all) sending a letter from a lawyer is totally over the top and in no way justified. I also doubt any lawyer would stoop to that, but then, they’re lawyers, so there’s that. On top of that, unless that neighbour owns the property, they have absolutely no business trying to enforce any rules there.

    All in all, either there’s more to this story, or OP met an actual crazy person. These exist everywhere and their craziness manifests in a variety of ways. Sending legal letters is one of the less scary ones, if you ask me.

        Währenddessen wohne ich in einer niedersächsischen Studentenstadt, wenn die Leute in meinem Haus es hinbekommen den Biomüll aus der plastikverpackung zu nehmen bevor sie ihn in die grüne Tonne werfen ist das seltener als ein Lottogewinn.

        Kartons zerkleinern? Absolut utopisch. Muss aber sagen das mache ich selbst auch nur bei größeren Sachen.

        Auf der haben seite, wir haben trotzdem selten Platzmangel in den Tonnen.

      Wenn die Nachbarn beim ersten Vorstellen schon betonen “Wir können über alles reden, wir sind ja keine Spießer”, du vom Vormieter weißt das “über alles reden” in Form von “…lautstark mit dem Nachbarn über dir während sie in deinem Garten steht” geschieht, und du dann irgendwann aus dem Nichts per Mail ne Beschwerde bekommst in der dein Schlafzimmer von außen fotografiert wurde und besagte nicht-Spießerin im Spiegelbild sichtbar ist…

    Just for explanation: The lady has probably not spent money on a lawyer. The lawyer demands it from you as the “guilty” party (presumed guilty, because no court is involved so far).

    If you want to save some money, google for the term “modifizierte Unterlassungserklärung”. Hopefully you find good instructions there.

      No, she’s in a Mieterschutzverein. They’ll pay the lawyers for the most stupid shit and somehow don’t care about how like 0.01% of their members are racking up 95% of their lawyer costs for insane reasons ¯\_(ツ)_/¯.

    Ich bin so froh dass unsere aktuelle Wohnung überdimensionierte Müllcontainer hat. Da kann einem fast alles egal sein, die werden niemals zu voll. Da falten die Hälfte der Leute auch keine Kartons. Und es ist einfach egal, weil genug Container dastehen. Was für ein Luxus!
