Can the IRS rewrite the health reform law through the regulatory process? In testimony last Thursday before the House Committee on Oversight and Government Reform, Jonathan Adler of the Case Western Reserve University School of Law and Michael Cannon of the Cato Institute argue that the IRS has done exactly that. They point out that the law authorized health insurance premium subsidies (which trigger penalties for employers) for coverage purchased through state-run exchanges – but the IRS issued a regulation allowing for those subsidies (and by implication, penalties) in federally-run exchanges as well.
